Parts Limited Warranty
(For parts purchased separately from a system purchase)
MPC Computers, LLC or any of subsidiaries or affiliates, including Gateway Companies, Inc. (as applicable, "MPC") provides standard parts warranties and technical support as part of your purchase, for the term shown on the front of your invoice or packing slip, in accordance with this MPC Parts Limited Warranty.
- Except as provided below, Parts associated with and shipped within 30 days of an MPC desktop, notebook, or server system carry the system limited warranty. Coverage begins on the ship date of the part and ends when the system limited warranty ends. Exception: Notebook batteries shipped within 30 days of a system carry a maximum limited warranty of one year from the system ship date.
- Parts shipped more than 30 days after a desktop, notebook, or server system, or not associated with a system carry a 90-day limited warranty, beginning on the ship date.
- Monitors shipped more than 30 days after a desktop, notebook, or server system, or not associated with a system carry a three-year limited warranty beginning on the ship date.
MPC's Limited Warranties and Terms and Conditions of Sale that were provided with the original system are incorporated herein by reference and apply to the purchase of Parts, except as expressly set forth herein.
For the purposes hereof, "Parts" means internal components and external peripherals (e.g. keyboard, mouse, and speakers) typically included with or configured with MPC desktop, notebook, and server systems. This limited warranty does not pertain to third-party products purchased through MPC Parts & Accessories, which are covered by their respective manufacturers' limited warranties. Third-party software products purchased separately from a system purchase are covered by their respective manufacturers' limited warranties, not by any MPC limited warranty. BOTH THIRD-PARTY PRODUCTS AND THIRD-PARTY SOFTWARE ARE SOLD "AS IS" AND WITHOUT ANY WARRANTY EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
In no event will either party be liable to the other for any indirect or consequential damages or lost profits arising from or related to the third-party products or third-party software. By using the third-party product or third-party software, you agree: (a) not to advertise or market the third-party product or third-party software as being associated with MPC or its affiliates, (b) that there is no right of return with respect to the third-party product or third-party software (except as provided below), (c) that you will pay all costs of shipping, (d) that this Agreement is made under and will be construed in accordance with the law of Idaho without giving effect to that state's choice of law rules and that Idaho courts have exclusive venue for any disputes arising out of or related to the third-party product or third-party software, and (e) you will indemnify and hold harmless MPC and its affiliates for any claims or damages arising with respect to your improper use of the third-party product or third-party software. If you do not agree to these terms, please return the third-party product or third-party software to MPC.
